General Terms and Conditions

If any section or part of a section of these terms and conditions is found to be invalid, void, or unenforceable, then that section or part of a section shall be severed from these terms and conditions and the remaining terms and conditions shall remain in full force and effect.

These warranty conditions are subject to the law of the country in which the product was purchased. This choice of law shall not include the provisions of international private law or the United Nations Convention on Contracts for the International Sale of Goods.

HD Vision Systems GmbH is entitled to subcontract the performance of HD Vision Systems GmbH’s obligations to third parties or to transfer HD Vision Systems GmbH’s obligations to perform the contract to third parties. However, this does not release HD Vision Systems GmbH from its obligations to you.

HD Vision Systems GmbH shall not be liable for any failure to perform or delay in performing the Product Warranty if such failure or delay is due to circumstances beyond the reasonable control of HD Vision Systems GmbH.

You agree that all information and data you provide to HD Vision Systems GmbH under this Product Warranty is neither confidential nor proprietary. You also agree that HD Vision Systems GmbH may collect and process your data on your behalf in order to provide the services. This may include the transfer of your data to companies or service providers affiliated with HD Vision Systems GmbH, which may be located in countries that do not provide the same level of data protection as your country of residence, including Australia, Canada, member states of the European Union, India, Japan, China and the United States.

HD Vision Systems GmbH has security measures in place to protect your information from unauthorized access or disclosure and from unauthorized destruction. You are responsible for any instructions you give HD Vision Systems GmbH regarding the processing of your data. HD Vision Systems GmbH will endeavor to comply with such instructions to the extent reasonably necessary to provide the Services and support obligations under the Product Warranty. If you do not agree with the above, or if you have any questions about how the described processing affects your data, please contact HD Vision Systems GmbH directly.

There are no oral representations, warranties or ancillary agreements to this warranty. Changes and/or additional agreements are only valid if they are documented in writing and signed in a legally binding manner. This also applies to agreements concerning the written form requirement itself.

The exclusive place of jurisdiction is the registered office of HD Vision Systems GmbH. Exclusive statutory places of jurisdiction remain unaffected by this.
